Personal Injury

Most personal injury cases are the result of negligence by one or more individuals. A plaintiff trying to prove negligence must establish that the defendant owed a duty of care, the defendant breached the duty, the breach caused injuries, and the plaintiff suffered actual damages. Many forms of compensation may be available to victims of preventable accidents, ranging from medical bills, lost income and earning capacity, and property damage to non-economic damages like pain and suffering and loss of enjoyment of life.

Workers’ Compensation

Workers’ compensation is a no-fault system in which you need not prove your employer was negligent in order to recover compensation for an injury or illness sustained on the job. Almost all public and private employers in Michigan are required to carry workers’ compensation insurance. The Workers’ Compensation Act limits what you can recover to specific wage loss benefits, medical bills, and certain rehabilitation services. Unlike personal injury cases filed in civil court, you cannot recover non-economic damages, but you may be able to pursue these through a personal injury claim against a third party that shared responsibility for the accident.

Social Security

The federal government creates and administers Social Security Disability Insurance (SSDI), which is a program that allows certain individuals with disabilities to meet their basic needs. To be eligible for benefits, you must have worked and paid Social Security taxes, and you must also have a disability that qualifies. A disability qualifies if it has prevented an individual from engaging in substantial gainful activity for 12 months or longer, or if it is expected to lead to death. Moreover, the disability must prevent the claimant from returning to work or finding another job.

In addition to assisting you with an SSDI claim, we also can advocate for your right to receive Supplemental Security Income (SSI) benefits, which are based on economic need rather than the claimant’s work history. Sometimes people suffering from disabilities may qualify for both SSI and SSDI.

Family Law

We are familiar with the complex issues that may arise in the divorce process, including child custody, child support, property division, and spousal support. Each state has its own residency rules that must be met in order to obtain a divorce. In Michigan, one of the spouses must have lived in the state for 180 days immediately before filing the complaint, and one of the spouses must have lived in the county in which the complaint is filed for 10 days immediately before filing the complaint. In Michigan, you can obtain a divorce without regard to fault, but fault may be considered in connection with property division and spousal support.
